Please read them carefully, and make sure you understand them, as you will be bound by these terms when you complete your purchase.

DEFINITIONS

The “Seller” is defined as the legal entity: CSB Trading Limited, trading as Mrs Mitchell’s. The “Buyer” means the person (legal or natural) who buys the goods. “Goods” is defined as the items to be supplied by the Seller to the Buyer as listed in your invoice.


GENERAL

These Terms and conditions shall apply to the sale of the Goods by the Seller to the Buyer to the exclusion of all other terms and conditions referred except where the Seller has agreed to such variation in writing and by way of signature. By ordering from the seller you agree to be legally bound by these Terms and Conditions and accept that these Terms and Conditions may be modified or amended on this website from time to time.

Afternoon Tea Boxes Terms and Conditions

Refunds and Cancellations

Orders for Afternoon Tea Boxes are final and non-refundable.

However, in some circumstances it may be possible to reschedule delivery or collection of your order. This will be entirely at the discretion of the management, and will also be subject to availability of the requested date. It may not be possible to reschedule your order with less than 48 hours notice.

In the very unlikely event that we have to cancel your order for any reason, then we will give you as much notice as possible, and discuss the matter with you and try to agree a suitable alternative. If you do not wish to accept our suggested alternative, then we will refund the full amount paid.

We reserve the right to withhold a £5 admin fee in the event that a refund is provided due to a cancellation where The Seller is not at fault.

Gifting an Afternoon Tea Box

If you are buying an Afternoon Tea Box as a gift, please make sure the recipient will be available to receive it on the day you have chosen before completing your order.

Deliveries are usually made between 12.00 and 2.30pm, please ensure the recipient knows to expect a delivery and will be available throughout the duration of that time to receive your order. If necessary, a nominated neighbour will be fine.

Refunds will not be given if delivery fails due to the recipients unavailability, or if the delivery is refused, and it may not be possible to rearrange delivery.

We may not able to leave your food unattended as part of your delivery, for example, on a step. We have a duty of care to provide food that is fresh and safe to eat, and therefore it must be handed to a person.

In some circumstances it may be possible to reschedule delivery or arrange collection of your order. This will be entirely at the discretion of the management, and will also be subject to staff availability and additional cost.

Delivery and Collection

Collection is available from our kitchen at 4-6 Staffa Place, Dundee, DD2 3SX. Collection is usually between 11.30-12.30pm. Please make sure someone will be available to collect your order between these times as it may not be possible to collect outside of these times.

In the event of any unexpected delays, please contact us as early as possible so we can discuss alternatives.

Collection times may occasionally vary, especially around, but not limited to, special occasions such as Christmas, Bank Holidays, or in the event of a special deal. Revised collection times will be stated on the main product page and will be confirmed on your order confirmation.

All collections are currently contact-less.

Delivery is available to book online to most areas of Dundee including City Centre, Invergowrie, Birkhill, Strathmartine, Douglas, (postcodes DD1-DD4) and Broughty Ferry, Monifieth and Kingennie! Please email/phone us for availability/prices outside of these areas. Sorry, we are not able to deliver to hospitals. We may be able to deliver to a care home but please check with them first, and then us, prior to ordering.

Orders for Afternoon Tea Boxes are final and non-refundable.

We will do our best to accommodate special requests but we do not guarantee it. If your request is vital then please discuss it with us before ordering.

Menu

Our afternoon teas are handmade to order and as such the menu and flavours provided will vary and we are unable to guarantee the exact contents of your Afternoon Tea Box. Pictures shown are usually of previous afternoon tea boxes and are for guidance only. Yours may vary slightly from those pictured.

Allergies and Special Dietary Requirements

Please discuss any allergies or special dietary requirements with us before ordering. We may not be able to accommodate your requirements and we cannot accept any responsibility for illness, or disappointment, that may arise as a result of non-disclosure prior to ordering.

We regularly use nuts and gluten on our premises and therefore cannot guarantee a nut or gluten free product.

We do not use fish products in our Afternoon Tea savouries because so many people ask us to exclude them.

Orders for Afternoon Tea Boxes are final and non-refundable.

Can I save my Afternoon Tea to enjoy another day?

Your afternoon tea will be freshly made to order with high quality, fresh ingredients. We do not use preservatives, and so we recommend it is enjoyed on the day of delivery/collection. We cannot guarantee the quality of your afternoon tea if it is not consumed on the day of receipt.

Coupon Codes, Gift Vouchers and Discounts

If you have a coupon code, discount or gift voucher, please make sure it has been applied correctly to your order before you finalise your order. Mistakes cannot be rectified once payment has been made.

Complaints

If you wish to make a complaint to us or let us know any concerns after receiving goods, please do so immediately in writing. Evidence of any faults, damages or discrepancies should be included with your complaint and any faulty items must be retained in case of further investigation. Disputes will be handled on an individual basis, and if resolution cannot be made we may refer the case to the local Environmental Health Department or Trading Standards.

Gift Vouchers

Unless otherwise stated, monetary gift vouchers may be redeemed against any of our products. To redeem against a food order, the order must be placed, and the relevant deposit paid on or before the expiry date noted on the voucher. Unless otherwise stated, gift vouchers and vouchers expire after 6 months of purchase. Gift Vouchers cannot be used to contribute to deposit payments, their full value will, instead, be deducted from the final balance.

Takeaway Afternoon Tea Box gift cards can only be exchanged for a Takeaway Afternoon Tea Box – original or vegetarian varieties. The voucher does not include delivery, but that can be added on at a later date, if required, and is subject to availability.

Bespoke Orders including celebration cakes and catering orders

Refunds and Cancellations

Deposits are non-refundable and non-transferable. Full payments for orders placed less than 4 weeks in advance of the delivery/collection date, payments for classes, and payments for orders valued under £50 are also non-refundable. Refunds may be subject to a cancellation fee. We cannot refund the cost of orders cancelled with less than 4 week’s notice. In the very unlikely event that we have to cancel your order, for any reason, then we will give you as much notice as possible, and discuss the matter with you and try to agree a suitable alternative. If you do not wish to accept our suggested alternative, then we will refund the full amount paid.

Payments and Deposits

For food orders over £50 we require a minimum 25% non-refundable deposit to confirm the order and the date (minimum deposit is £50).  The remaining 75% is due 4 weeks before the collection/delivery date at the latest. Changes made to previously agreed designs/menus may incur extra fees. Orders placed less than 4 weeks in advance of the delivery/collection date, orders for classes, and orders valued below £50 must be paid in full at the time of ordering. Failure to complete payment 4 weeks before the delivery date may result in your order being cancelled.

Product Information

The images on the website are merely examples of our products. All our products are hand made to order. Unless specifically agreed, Afternoon Tea menus are subject to variations from website images.

Consultations

Consultations are available to discuss your requirements by appointment only. Cake sampling can also be arranged for a fee.

Price Quotations

All price quotations, written or verbal, are valid for 10 days from the date of quotation.

Alterations

If you have any queries or need to make any changes to an order please contact us immediately. Alterations and amendments must be submitted in writing. We will assess the request for an alteration, and endeavour to make alteration where possible dependant on the design and amount of notice given. We will let you know its effect on the price and any agreed timetable. Accepting any alterations is at the discretion of the Seller. It is the Buyer’s responsibility to check any quotes and invoices thoroughly before making payment. We reserve the right to change the design at any point if circumstances beyond our control compromise the quality of the finished product. e.g. weather conditions, availability of ingredients. The Buyer will be notified of any such changes and we will endeavour to keep any changes minimal.

Damages

The buyer, or their representative, will be invited to inspect the goods at the time of delivery/collection. In the unlikely event that a fault is found, an appropriate solution will be agreed with the buyer, or their representative. The buyer, or their representative, will be required to sign for receipt of the goods, by doing so they agree that the goods are satisfactory. The Seller accepts no liability for goods that are damaged after they have been signed for.

All For Cakes Sake products are fragile and require care and attention when handling, storing, and displaying. It is recommended that all products are stored and transported flat. The seller recommends that our products are transported in the boot of the car where they can lay flat. Please pay careful attention to any additional storage and transportation (where relevant) instructions that will be provided with your goods.

Equipment Hire

Equipment may be provided to you for hire. A minimum security deposit of £50 may be required at the time of delivery/collection. This will be taken in cash, and will be returned, in full, when the equipment has been returned in perfect condition.

In the event that an item(s) becomes damaged or lost, the Buyer will become liable for the cost of replacement of that item(s). A copy of an invoice, receipt, item listing, or quote will be provided to The Buyer as proof of the cost of replacement. In most cases, the cost of replacement will be deducted from the deposit. In the event that this is not possible, an invoice will be generated for the amount due. This must be paid by The Buyer within 7 days of the end date of the hire period, or generation of the invoice, whichever is sooner.

Unless otherwise agreed, the hire period is 7 days.

Hired equipment must be returned to our kitchen in Dundee. Return times are by arrangement with The Seller.

Delivery and Collection

We cannot be held liable for any damages to the goods once they have been accepted. The collection vehicle should have a flat surface and be clean and tidy. This is the responsibility of the Buyer. The goods may be fragile so we advise the buyer, or their representative, to drive very slowly and carefully. We also recommend non-slip matting. A time slot will be given for delivery/collection, we cannot guarantee delivery or collection will be available outside of that time so please make sure someone is available to receive delivery for the duration of that time, or ensure prompt collection. Refunds will not be given if delivery or collection fails due to the buyers unavailability. In the event of any unexpected delays, please contact us as early as possible so we can discuss alternatives. In the unlikely event that we are delayed we will stay in close contact with you and we and will always endeavour to deliver the goods to you as close as possible to the given delivery time.

After Delivery

It is the responsibility of the buyer to ensure the venue is able to accommodate the goods we provide. Please check with them before making a booking to ensure they are willing to accept goods from external caterers and that they can fully accommodate you in terms of display, service, serving dishes, plates, cutlery, and tea cups and whatever else you may need to serve the food we have provided.

Our products are best enjoyed within 24 hours of delivery/collection. However, celebration cakes may last up to a week if kept at an ambient temperature (do not refrigerate, unless otherwise advised), in an air tight container. Some items such as savoury items, items made with fresh cream and macarons will need to be refrigerated to maintain freshness.


Non-Edible Ingredients and Decorations

Our Goods may contain non-edible ingredients or decorations, such as plastic dowels in tiered cakes or wires in some sugar flowers. These will be detailed on the Delivery Note and must be removed before serving.


Complaints

If you wish to make a complaint to us or let us know any concerns after receiving goods, please do so immediately in writing. Evidence of any faults, damages or discrepancies should be included with your complaint and uneaten food must be retained in case of further investigation. Disputes will be handled on an individual basis, and if resolution cannot be made we may refer the case to the local Environmental Health Department or Trading Standards.

Class Bookings

Unfortunately we cannot issue a refund if you need to cancel your class booking. If you wish to book onto a different class this may be possible in some circumstances, and transfers will be at the discretion of the manager. We reserve the right to cancel any class. In the unlikely event that we have to cancel a class, we will offer a full refund, the option to reschedule or a transfer to another class.

If the alternative class differs in price an additional payment/refund will become due, as appropriate. We will endeavour to advise you as far in advance as possible if we do need to cancel a class.

Afternoon Tea Club Terms and Conditions

Membership

You will be automatically billed on a monthly basis for your membership to the Afternoon Tea Club. You are free to cancel or pause your membership at any time, and as such no refunds will be given for membership fees paid.

If you availed of a free trial then you will automatically be billed at the end of your trial period, and monthly there after. You can manage your subscription via your account.

Delivery and Collection of your Treat Box

Delivery of your treat boxes is only available to selected postcodes in Dundee that begin DD1-, DD2-, DD3-, DD4- and DD5-. We are not able to deliver to areas outside of these postcodes, if your address is outside of this area your treat box will be available to collect during our normal collection hours.

Please ensure the billing address you enter is within our delivery area, if it is not, you will be expected to collect your treat box from our kitchen within the normal collection times. Treat boxes are available to members on the 3rd Sunday of every month

Deliveries are usually made between 10-4pm.

If you are unavailable for delivery we will attempt to leave your box with a neighbour. If that is not appropriate then we will leave it in a secure place if there is one.

The treat boxes will contain a mystery treat which may contain many different yummy things, some of which may be allergens. We are not able to accommodate allergies, special diets or special requests, and we cannot accept any responsibility for illness, or disappointment, that may arise as a result of an allergy or special request. The ingredients we have used will be clearly listed with the product.

Can I save my treat box to enjoy another day?

Your treat box will be made fresh to order with quality ingredients so we recommend it is eaten on the day of delivery. However, the scones will be suitable for freezing and warming up later, and the main treat may also be suitable for storing. Full details will be included in each box.

Coupon Codes, Gift Vouchers and Discounts

As a member of our Afternoon Tea Club you will be entitled to a 10% discount code on Afternoon Tea purchases, Event Fees, Classes, Signature Bakes, Afternoon Tea Gift Cards (excludes eVouchers and vouchers that have a numerical value). You will also be entitled to a free perk with every order. Your members discount may not always be redeemable with other discounts or offers that may be available, please choose the best value offer for you. The discount can be used on an unlimited number of purchases, subject to fair usage, subject to availability, and subject to a maximum of 8 people/servings per collection/delivery date, ie 8 x afternoon tea boxes for one, 4 x afternoon tea boxes for two, or 2 x afternoon tea boxes for four. We reserve the right to amend this rule at any time and will give a full months notice of this change.

You can also follow any link that has been emailed to you in relation to your club membership, or log into your account and follow links to discounted products from there. The perks and discounts are not available on our usual purchase pages.

Members Perks

Members are entitled to pick a free perk when purchasing an afternoon tea box only. The perks may vary from month to month and we do not guarantee the value of the perks at any time.

Making a purchase

Our normal terms and conditions will apply to all purchases that are made via our website.

When you order via our website you will, as a member, be automatically bound by our normal terms and conditions of purchase which are listed at the top of this page. Please read and understand them fully. By being a member you are agreeing to these as part of your membership.

Usage

Membership discounts and perks are for the sole use of the subscriber only. You must not share your account details with anyone. The management reserves the right to temporarily suspend or cancel membership benefits without notice if they believe the account is being misused. No refunds will be offered in this case and losses may be sought.
